Posting Requirements for OSHA Final Rule

We recently posted about OSHA’s announcement of their Final Rule, which requires employers to electronically submit the injury and illness data that they are already required to record on their on-site OSHA injury and illness forms. But we want to elaborate more on the requirements.

What will this information be used for?

This requirement is issued in hopes of encouraging employers to improve workplace safety and provide valuable information to workers, job seekers, customers, researchers, and the general public. Analysis of the data will improve OSHA’s ability to identify, target, and remove safety and health hazards, thereby preventing workplace injuries, illnesses, and deaths. This information will be publically available on osha.gov, with the removal of any Personally Identifiable Information (PII).

How much information will need to be submitted?

The amount of data submitted by employers will vary on the size of the company and industry. Read the full breakdown.

How to submit the information?

Establishments must submit the information electronically, not on paper. OSHA will provide a secure website that offers three options for data submission. Here are the general steps below.

  • Employers will be able to manually enter data into a web form (via OSHA)
  • Employers will be able to upload a CSV file to process single or multiple establishments at the same time.
  • Employers of automated recordkeeping systems will have the ability to transmit data electronically via an API (application programming interface).

When will the information need to be submitted?

The OSHA Form 300A, (Summary of Work-Related Injuries and Illnesses) must be completed and posted no later than February 1 and until April 30th, 2017.  

Establishments with 250 or more employees must begin submitting information from Form 300A by July 1, 2017, and must submit information from all forms (300A, 300, and 301) by July 1, 2018. Beginning in 2019 and every year thereafter, the information must be submitted by March 2.

Establishments with 20-249 employees in certain high-risk industries must begin submitting information from Form 300A by July 1, 2017, and again by July 1, 2018. Beginning in 2019 and every year thereafter, the information must be submitted by March 2.
